2. Changes to Terms:

RD3 Tech may revise these Terms and Conditions at any time to reflect changes in our services, policies, or business needs. Updates take effect immediately upon publication on our website.

3. Acceptance of Work:

RD3 Tech carefully reviews all contracts, roles, projects, and assignments. We reserve the right, at our sole discretion, to accept or decline work based on factors we deem critical to ensuring quality, safety, and alignment with our business standards.

4. Client Attendance:

The client must be present at the scheduled start time of the service.
  • RD3 Tech will not engage or coordinate with any third party unless the client attends the initial meeting and is included in all subsequent communications, or the third party has been introduced and authorised by the client.
  • Any work that requires third-party involvement or sign-off must be authorised by the original client. All third-party tasks must be reviewed and approved by the client before work begins.

5. Client Responsibilities:

To ensure efficient and safe service delivery, clients are responsible for:
  • Providing a clean, sanitary, and accessible worksite suitable for the service.
  • Providing accurate and complete information about the issue or project.
  • Granting necessary access to systems, software, or hardware required for the service.
  • Obtaining any required permissions or licences for third-party software or systems. If the worksite or required information is not suitable at the time of arrival, we may need to reschedule. Any additional costs resulting from this will be discussed with the client in advance.

6. Politeness & Professionalism:

RD3 Tech is committed to delivering services in a respectful, courteous, and professional manner. We expect the same from clients and any third parties involved.
  • Abusive, aggressive, bullying, manipulative, or disrespectful behaviour — including but not limited to shouting, swearing, threats, intimidation, harassment (verbal, written, or online), discriminatory remarks, or any conduct intended to cause distress — will not be tolerated. If any of the aforementioned issues arise, any repairs or services will be suspended and client hardware will be returned in its current state, whether already repaired, mid-repair, or pending repair following client instruction. Services will also be terminated without refund. RD3 Tech will not be liable for incomplete repairs, data loss, or any resulting issues caused by the suspension of service.   • Unreasonable demands or requests leading to harassment, intimidation, or bullying — including but not limited to demanding same-day service, expecting instant responses to emails, excessive follow-ups, or repeated pressure outside agreed-upon communication channels — may result in suspension or termination of services without refund. Also see Section 7. Booking & Scheduling.
  • In such cases, RD3 Tech may limit or cease further communication with the client to maintain a safe and respectful working environment.

7. Booking & Scheduling:

RD3 Tech uses a structured booking and enquiry process to help manage requests fairly and provide each client with the appropriate level of attention. Our website and Client Intake Form are the primary starting points for new work and planned requests, while email and phone/text are used according to the type and urgency of the request.

To ensure timely and effective support:

  • Requests for new work should be submitted through the RD3 Tech Client Intake Form. This allows us to gather the information needed to understand your request and determine the appropriate next step.
  • Email is the preferred contact method for planned work, questions, and service requests.
  • Appointments are managed through our private booking system, with clients scheduled in the order requests are received.
  • Please book planned work in advance where possible. RD3 Tech recommends allowing at least one week for non-urgent requests.
  • Same-day or priority service is only available for urgent situations and is assessed on a case-by-case basis.

The following examples help explain the difference between planned bookings and enquiries and urgent support requests. These examples are a guide only and are not limited to the situations listed below.

RD3 Tech will assess each request based on:

  • The impact on the client
  • The urgency of the situation
  • The appropriate response required

Bookings & enquiries:

This includes questions, planned work, improvements, recommendations, and other requests that can be handled through the normal support process.

Home users:

  • Computer servicing and health checks
  • Performance improvements and upgrades
  • New computer setup
  • Data transfers and device setup
  • Software installation and configuration
  • Printer, Wi-Fi, and home technology support
  • Backup setup and technology advice

Small business / Community organisations:

  • Booking IT support appointments
  • Requesting quotes or recommendations
  • New device and user setup
  • Google Workspace or Microsoft 365 support
  • Email, domain, and hosting services
  • Website updates and improvements
  • Technology reviews and planning
  • Backup, security, and IT consulting

Email allows RD3 Tech time to review your request, understand your requirements, and provide the most appropriate solution.

Urgent support:

Phone or text is available for urgent technology issues where assistance is required promptly.

Examples include:

Home users:

  • Computer will not turn on or has suddenly failed
  • Unable to access important files or personal data
  • Suspected virus, malware, or account compromise
  • Internet or network failure affecting essential use
  • Urgent data recovery situations

Small business / Community organisations:

  • Critical system or device failure preventing normal operations
  • Staff, volunteers, or members unable to access essential systems
  • Email, cloud services, or shared systems unavailable
  • Security incidents requiring urgent attention
  • Technology failures affecting important deadlines, events, or operations

8. Required Information:

Clients must provide:

  • Full name.
  • Email address.
  • Home or business address.
  • Contact phone number.

Clients are responsible for notifying RD3 Tech promptly of any changes to this information to ensure effective communication.

9. Pricing:

All invoices issued by RD3 Tech are final and not subject to amendment, adjustment, or reversal once issued.
  • Standard Rate: $110/hour minimum.
  • After-Hours Rate: +$20/hour outside 9–5, weekends, or public holidays.
  • Travel Charges: Calculated as: (Standard Rate ÷ 60 minutes) × travel time in minutes = travel rate. Also see Section 10. Travel & Location Fees.

10. Travel & Location Fees:

Travel fees apply to all services. Travel Calculation: (Standard Rate ÷ 60 minutes) × travel time in minutes = travel rate. RD3 Tech provides services within Whangārei City and Tutukaka Coast. Travel rates apply to all services, including those within Whangārei. Services outside these areas are at RD3 Tech’s discretion.

11. Quotes & Consultations:

  • Estimates are available upon request.
  • Consultations, estimates, quotes, recommendations, research and related professional services may incur hourly fees, based on the time, effort, complexity and research required.
  • Site visits undertaken for the purpose of providing a quote, estimate, consultation or recommendation are charged at RD3 Tech’s standard hourly rate, together with any applicable travel or location fees.
  • Costs may vary depending on the scope, requirements and complexity of the work.
  • Recommendations, proposals, reports, quotes, consultations and estimates, including any associated research or supporting material, may be provided to the client or business following payment of the applicable invoice.
  • Providing an estimate, quote or consultation does not create an obligation for RD3 Tech to undertake the proposed work. Work will only proceed once the client has confirmed acceptance of the proposed services and any applicable terms.

12. Payment Terms:

  • Invoices must be paid by the stated due date via accepted payment methods.
  • Contact us before the due date if you require an extension.
  • At the discretion of RD3 Tech staff, late payments without prior approval may incur a late fee after 7 days.
  • Unpaid invoices beyond 14 days may result in suspension of services or referral to a collections agency.

13. Our Services:

  • On-Site IT Support: Diagnosis and repair at your location.
  • Remote Support: While we may provide remote support, we prefer to conduct on-site visits to ensure optimal service delivery. Remote assistance will be assessed on a case-by-case basis.
  • Drop-Off Service: Repairs by appointment only at our facility. For certain jobs, a drop-off service may be required at the RD3 Tech workshop. Repairs are by appointment only. Clients must not enter the property without permission. All visits must be scheduled in advance with notice. Clients may not return without explicit approval.

14. Data Privacy:

RD3 Tech is committed to protecting your personal and business information in accordance with applicable data protection laws. Any personal or sensitive data provided to us will be used solely for delivering our services and will not be shared with third parties without your explicit consent, except as required by law. Any data stored on hardware during the provision of our services will be erased upon completion of the service. RD3 Tech will not store or collect any data of a personal or business nature. We implement reasonable technical and organisational measures to safeguard your data.

15. Dispute Resolution:

Any disputes arising from these Terms and Conditions or from our services will first be addressed through good-faith negotiation between the parties. If the matter cannot be resolved, and/or legal action is pursued, RD3 Tech reserves the right to suspend services and classify any outstanding amounts as bad debt.

16. Service Quality:

RD3 Tech strives to deliver high-quality services to meet client expectations. If you are dissatisfied with our work, please contact us within 7 days of service completion to discuss your concerns. While we aim to resolve issues promptly, all services are provided “as is” as outlined in Section 25.7. Warranties & Service Limitations, and no additional warranties or guarantees are provided unless agreed in writing.

17. Refund Policy:

Payments are non-refundable unless RD3 Tech fails to deliver agreed services due to our sole fault. Refunds, if issued, will not exceed the amount paid for the specific service.

18. Subcontracting:

RD3 Tech may, at our discretion, engage subcontractors to perform certain services. Any subcontractors will be held to the same standards of professionalism and quality as RD3 Tech. We remain fully responsible for the quality and delivery of services, regardless of subcontractor involvement.

19. Termination of Services:

RD3 Tech reserves the right to terminate services or agreements at our discretion for reasons including, but not limited to, non-payment, failure to comply with these Terms and Conditions, or circumstances that make service delivery impractical or unsafe. Upon termination, clients remain liable for all fees incurred up to the termination date. RD3 Tech will provide written notice of termination where feasible. Also see Section 6. 20. Feedback & Complaints:

Feedback must be professional and constructive. Complaints will be acknowledged within 7 days and addressed reasonably. Unprofessional or unconstructive complaints may be deemed a breach of Section 6. Politeness & Professionalism.

21. Insurance:

RD3 Tech does not provide or maintain any professional liability or general liability insurance for the services we offer. Any claims for loss, damage, or liability arising from our services are not covered by insurance and are subject to the limitations in Section 25.1. Limitation of Liability.

22. Accessibility:

RD3 Tech is committed to making our services accessible to all clients. If you have specific accessibility needs (e.g., mobility, communication, or other accommodations), please inform us at the time of booking so we can make reasonable arrangements to meet your requirements.

23. Service Area:

RD3 Tech primarily operates within Whangārei City and the Tutukaka Coast. Services outside this area may be available at our discretion, subject to additional travel fees as outlined in Section 10. Travel & Location Fees.

24. Non-Solicitation:

During the term of service and for 12 months thereafter, clients agree not to directly or indirectly solicit, hire, or engage any RD3 Tech employees, contractors, or subcontractors for services outside of RD3 Tech’s involvement without our prior written consent.

25. Legal Protection Clauses:

25.1 Limitation of Liability:

RD3 Tech is not liable for any loss, damage, or costs (including loss of data, profits, or business) resulting from the use of our services, to the fullest extent permitted by law. We are not responsible for indirect, incidental, special, or consequential damages, even if advised of the possibility. Any liability is limited to the total amount paid by you for the specific service giving rise to the claim.

25.2 Data Loss Disclaimer:

We take reasonable precautions to protect your data; however, we cannot guarantee against accidental loss or corruption. Clients are responsible for maintaining complete backups of all important data before we begin work. RD3 Tech is not liable for any data loss, regardless of cause.

25.3 Hardware Failure Disclaimer:

RD3 Tech provides technical support and services related to hardware but does not guarantee the continued operation or lifespan of any hardware devices. We are not liable for failures, defects, or malfunctions of hardware components before, during, or after our service. Clients are responsible for backing up data and for any hardware repairs or replacements beyond our scope of work.

25.4 Third-Party Products & Services:

We may recommend or facilitate products or services from third-party providers. RD3 Tech is not responsible for the performance, warranties, or suitability of any third-party product or service. Any issues must be addressed directly with the third-party provider.

25.5 Cancellations & No-Shows:

To ensure we can provide reliable service and allocate time fairly for all clients, the following cancellation and rescheduling terms apply. These terms outline the responsibilities of both the client and RD3 Tech when an appointment cannot proceed as scheduled.

RD3 Tech will make every reasonable effort to attend and complete all scheduled appointments as planned. However, there may be occasions where circumstances beyond our reasonable control prevent us from safely or reliably delivering the scheduled service. In these situations, the appointment may be cancelled and rescheduled.

This includes, but is not limited to:

  • Illness or unwellness affecting RD3 Tech personnel
  • Power outages or electrical failure
  • Internet, broadband, or mobile network disruptions
  • Hardware or software failure required to deliver the service
  • Travel disruption, road closures, severe weather, or access restrictions
  • Any other unforeseen event that prevents safe, reliable, or practical service delivery

Where an appointment is cancelled for any of the above reasons, RD3 Tech will notify the client as soon as reasonably practicable and arrange a new appointment time at no additional charge.

RD3 Tech also reserves the right to cancel or reschedule appointments due to operational requirements, staff unavailability, or other business constraints. Where possible, RD3 Tech will provide notice as soon as reasonably practicable and arrange an alternative appointment time.

RD3 Tech is not liable for any loss, inconvenience, delay, cost, or consequential impact arising from appointment cancellations or rescheduling.

Additional appointment terms:

  • RD3 Tech may cancel or reschedule appointments due to operational requirements, staff unavailability, or other business constraints.
  • Where possible, RD3 Tech will provide notice as soon as reasonably practicable and arrange an alternative appointment time.
  • RD3 Tech is not liable for any loss, inconvenience, delay, cost, or consequential impact arising from appointment cancellations or rescheduling.
  • If a client cancels less than 24 hours before a scheduled appointment, a cancellation fee equal to one hour of the standard rate will apply. Please refer to Section 9. Pricing or RD3 Tech Rates.
  • If RD3 Tech arrives at the agreed appointment time and is unable to commence work due to site inaccessibility, safety concerns, or client absence, the appointment will be treated as a no-show and charged accordingly.
RD3 Tech aims to provide reliable, timely, and professional service for every client. These terms are in place to ensure fairness, clarity, and efficient scheduling for all parties. We appreciate your understanding and cooperation.

25.6 Force Majeure:

RD3 Tech is not liable for delays or failure to perform services due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, public health emergencies, power outages, supply shortages, internet failures, labour disputes, government restrictions, or other unforeseen circumstances. We will notify clients of any delays caused by such events and work to reschedule services promptly.

25.7 Warranties & Service Limitations:

All services are provided “as is” without warranties of any kind, express or implied. We do not guarantee that any service or product will be error-free, uninterrupted, or compatible with all systems.

25.8 Ownership of Work & Intellectual Property:

Unless otherwise agreed in writing, all custom software, scripts, documentation, website code, design, images, and other materials or data created by RD3 Tech remain our intellectual property until full payment is received. Upon full payment, agreed deliverables will be licensed to the client for their intended use, excluding any proprietary tools, code libraries, or processes used internally by RD3 Tech. Until payment is received in full, RD3 Tech reserves the right to withhold, disable, or restrict access to the work.
